This End User License Agreement (“Agreement”) is a legally binding contract between the end user (“You” or “User”) and Performance Systems Development (“PSD”) governing the use of the TREAT Software (“Software”). By installing or using the Software, you agree to comply with the terms and conditions set forth in this Agreement.
PSD reserves the right to update, modify, or revise this Agreement at any time without prior notice. Continued use of the Software following any such change constitutes acceptance of the updated Agreement. Users are encouraged to review this Agreement periodically. Site Licensing Options
Site licenses are available for organizations that require access to the TREAT Software across multiple users, departments, or devices within a defined entity (e.g., a company, agency, or educational institution).
- Definition & Scope: A site license permits the installation and use of the Software on multiple machines within the licensed organization, subject to the terms specified in the site license agreement. This may include concurrent use limits, geographic or network restrictions, and designated user groups.
- Customization & Pricing: Site license terms, pricing, and deployment models are customized based on the size, structure, and needs of the organization. Interested parties should contact PSD directly to inquire about eligibility and obtain a formal site license agreement.
- Agreement Supersession: Any separate site license agreement executed between PSD and an organization shall take precedence over conflicting terms in this End User License Agreement, to the extent of such conflict.
- Support & Updates: Site license holders are eligible for the same level of technical support, patches, and upgrades as individual licensees, subject to the active support terms outlined in the site license agreement.
TREAT General Policies
- Each license is issued with a unique Serial Number. This Serial Number must be entered into the Software to enable use.
- The license period begins on the date the Serial Number is issued and is valid for one year. Renewals extend the license for an additional one-year term.
- During the active license period, Users are entitled to basic technical support, software patches, and upgrades.
- Complimentary copies of TREAT and any upgrades received during the first year may continue to be used beyond the initial license term. However, a valid renewal is required to continue receiving technical support and future upgrades after the first year.
- Each TREAT license is assigned to a single computer and user. Use of the Software on shared virtual machines is prohibited and constitutes a violation of this Agreement.
- One complimentary license transfer is permitted under an active support plan. Additional transfers may be requested at a cost of $50 per transfer through the TREAT Store.
- Support inquiries must be submitted via the TREAT Help Desk. Full registration instructions are available in the Software documentation and online.
TREAT Trial Policies
- The trial version allows Users to install and operate the single-family functionality of TREAT.
- Report printing and multi-family functionality are disabled in the trial version.
- The trial license expires 30 days from the date of initial installation.
- Software patches and upgrades are not provided during the trial period.
- Support for trial users is limited to self-service access via the TREAT Knowledgebase: https://treat.freshdesk.com/support/home
Discretionary Exceptions
From time to time, and at its sole discretion, PSD may grant exceptions to this Agreement on a case-by-case basis.
- Any such exception must be provided in writing by PSD.
- A granted exception does not constitute a waiver of any provision of this Agreement.
- Exceptions granted under specific circumstances shall not establish a precedent or obligate PSD to grant similar exceptions in the future.
Intellectual Property Notice
All rights, title, and interest in and to the Software, including but not limited to all intellectual property rights, are and shall remain the exclusive property of PSD. This Agreement does not transfer to the User any ownership rights to the Software.
